Fact or Fiction: Public Access

October 29, 2012 by Charli Williams

A little quiz for your Monday afternoon:

Fact or Fiction: Placing a conservation easement on a piece of land opens the property up to allow for public access.

FICTION.  Lands placed under conservation easement continue to be privately owned and as such, public access is not automatically granted.  Like all private lands, the decision to grant access remains at the sole discretion of the landowner.

So what should you do if you’d like access to an easement property for hunting, fishing or even just to pass through to public lands?  The same thing as you would do to gain access to any other private lands: contact the landowner & ask their permission.  LRLT’s staff & board have no authority to grant access to our conservation easement properties, nor do we provide any input into the decisions made by each individually landowner regarding granting access .
